DuraMAX® 10-Year/up to 500,000 Miles Lubrication Limited Warranty

Subject to the exclusions, limitations, terms, conditions, and eligibility requirements set forth in this limited warranty, RelaDyne, Inc., a Delaware corporation, will reimburse you at reasonable cost for the repair or replacement of the engine parts listed below that fail as a direct primary result of lubrication related failure while the DuraMAX motor oil is properly installed. This limited warranty is available to the vehicle owner or lessee of an Eligible Vehicle who has their oil changed by an automotive center, commercial oil change facility, or auto dealer who uses synthetic blend, high mileage, full synthetic, and advanced full synthetic DuraMAX motor oils (henceforth referred to as “DuraMAX motor oil” where the category is not explicitly specified).

TO THE EXTENT PERMITTED BY LAW, ANY APPLICABLE IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED IN DURATION TO THE SAME DURATION AS THIS WARRANTY. RELADYNE, INC. SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR FAILURE OF DURAMAX MOTOR OIL, HOWEVER CAUSED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES YOU CERTAIN LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

ELIGIBILITY REQUIREMENTS:

This limited warranty is only available to legal residents of the United States who own or lease an “Eligible Vehicle” and whose name appears on the Statement of Warranty after completion of the registration process. An “Eligible Vehicle” is a privately owned or leased (if you are primarily obligated for repairs and maintenance) passenger car, van, SUV or light truck with a gross vehicular Weight of 10,000 pounds or less and the odometer has fewer than 100,000 miles at the time of the initial use of DuraMAX motor oil and whose manufactured date is within the last 60 months of your initial use of DuraMAX motor oil. Fleets of commercial or heavy duty vehicles are not eligible for the DuraMAX Warranty Program. A fleet is considered a grouping of vehicles that are owned and managed by a single business.

Vehicles used, registered, modified, or leased for commercial, off-road or agricultural, emergency, delivery, or competitive purposes and fleet vehicles do not qualify for this limited warranty. This limited warranty does not cover vehicles subject to abnormal driving conditions or vehicles used in any manner not recommended by the vehicle manufacturer.

This limited warranty is transferable. You can transfer this warranty before your vehicle has been driven 125,000 miles, but only if the person you transfer it to has copies of your receipts or can prove your compliance with the terms of this limited warranty.

WHAT YOU MUST DO FOR THIS LIMITED WARRANTY TO APPLY:

To apply for this warranty, you must complete the vehicle enrollment process (except in states where registration is not required) at www.duramaxwarranty.com. Upon completion of the enrollment process a Statement of Warranty will be issued. You must record the Eligible Vehicle’s mileage to complete the registration process. YOU MUST CHANGE THE ELIGIBLE VEHICLE’S OIL EXCLUSIVELY AND CONTINUOUSLY WITH THE APPROPRIATE CATEGORY OF DURAMAX MOTOR OIL AND THE DURAMAX OIL MUST BE PROPERLY INSTALLED.

You must change the Eligible Vehicle’s motor oil at least one time per year and as often as recommended by the vehicle manufacturer (based on whether the Eligible Vehicle is subject to normal or severe conditions as classified by the vehicle manufacturer) or before every 7,500 miles, whichever first occurs, using DuraMAX motor oil to qualify for this limited warranty.

If the vehicle manufacturer recommends a mileage interval greater than 7,500 miles, you must change the Eligible Vehicle’s motor oil at least one time per year and as often as recommended by the vehicle manufacturer (based on whether the Eligible Vehicle is subject to normal or severe conditions as classified by the vehicle manufacturer) or before every 10,000 miles, whichever first occurs, using DuraMAX Synthetic motor oil, to qualify for this limited warranty.

You must service the Eligible Vehicle’s engine in the service classification and viscosity grade as recommended by the manufacturer; change the Eligible Vehicle’s oil and oil filter at least as often and as recommended by the manufacturer; maintain the Eligible Vehicle’s emission control system in compliance with the manufacturer’s recommendation; replace the Eligible Vehicle’s air filter and air cleaner elements at least as often recommended by the manufacturer; follow all scheduled engine maintenance as recommended by the manufacturer. You must keep all motor oil receipts as proof of purchase.

DURATION OF LIMITED WARRANTY:

This limited warranty takes effect 90 days after your first eligible purchase of DuraMAX motor oil or 3,000 miles after your initial DuraMAX motor oil installation, whichever occurs last. As long as you comply with the terms and conditions stated herein, this limited warranty covers the engine parts listed below that fail as a direct primary result of lubrication related failure from the time you were eligible for this limited warranty up to as follows:

• 10 years or 300,000 miles (whichever is first) if you exclusively use DuraMAX Synthetic Blend, High Mileage, or Full Synthetic motor oil.
• 10 years or 500,000 miles (whichever is first) if you exclusively use DuraMAX XLT Advanced Synthetic motor oil.

You may change your level of warranty protection at any time as long as the Eligible Vehicle has fewer than 100,000 miles and a manufactured date within the last 60 months.

COVERAGE:

Subject to the terms, conditions, and limitations contained herein, RelaDyne, Inc. agrees to reimburse you at reasonable cost for the repair or replacement of the following internally lubricated parts of the Eligible Vehicle’s original factory installed engine that fail as a direct primary result of lubrication related failure while the DuraMAX motor oil is properly installed:

The time to make the repairs or to replace the covered parts shall be no more than the time allocated by Chilton’s Flat Rate Guide or other industry accepted standard.

THE AGGREGATE LIMIT OF LIABILITY FOR A CLAIM OR CLAIMS RELATED TO AN ELIGIBLE VEHICLE IS $3,000.

In no event shall the payment of any claim exceed the fair market value of the Eligible Vehicle at the time of the claim as set forth by Kelley Blue Book or some other similar listing of vehicle values.

THIS LIMITED WARRANTY DOES NOT COVER CLAIMS ALSO COVERED BY THE ELIGIBLE VEHICLE’S MANUFACTURER WARRANTY OR ANY EXTENDED SERVICE CONTRACT OR WARRANTY. This limited warranty does not extend the Eligible Vehicle’s manufacturer’s warranty.

If RelaDyne, Inc. pays anything under this limited warranty, and you have a right to recover from another party, your rights will become RelaDyne Inc.’s rights, up to the amount RelaDyne Inc. has paid.

CLAIM PROCEDURE:

To make a claim under this limited warranty, you must notify DuraMAX in writing, no later than 30 days after the date of any damage and prior to the expiration of this limited warranty. The address to send notice of a claim is:

Before any repairs are authorized to an Eligible Vehicle, you must provide: the Statement of Warranty and all receipts showing oil changes or purchases using DuraMAX motor oil with dates; copies of all service and repair orders; copy of your lease agreement or vehicle registration; a statement of damage and repair costs; a sample of the motor oil, if requested.

RelaDyne, Inc. may, at its expense, conduct further investigation as may be required to determine the cause of the claimed problem and your eligibility under this limited warranty. RelaDyne Inc. is only responsible for repairs it approves.

If you have complied with all of the terms and conditions of this limited warranty, RelaDyne, Inc. will approve the claim and make payment, as provided herein, after the repairs are completed.

ADDITIONAL TERMS, CONDITIONS, LIMITATIONS, AND EXCLUSIONS:

This limited warranty does not cover any damage that occurs prior to the effective date of coverage.

RelaDyne Inc.’s obligation to repair or replace any listed part, as may be required, is the sole and exclusive remedy available under this limited warranty. RelaDyne is only responsible for the repairs it approves.

The failure of any part listed in this limited warranty that is related to any pending legal proceeding or recall for which the manufacturer has announced responsibility by any means is excluded from coverage.

This limited warranty does not cover any parts or components not specifically listed above or any claims that are the result of improper service or maintenance, improper installation of any part, defect in manufacture of any part, collision or accident, negligent, reckless or knowing intentional damage, road hazard, overheating, fire, theft, vandalism, riot, explosion, lightening, water or flood damage, freezing, salt, environmental condition, chemicals, contamination of fluids, fuels, coolants or lubricants, or acts of God.

This limited warranty may be deemed void if your registration or other information submitted contains untrue information or if your vehicle is not an Eligible Vehicle.

The terms and conditions of this limited warranty may only be changed by DuraMAX.
